It is expressly sanctioned the prohibition of parking on pavements, dispelling the doubts on the applicability of the Highway Code, caused by the fact that it applies to vehicles: scooters are considered only devices.
The only penalty evoked by the Legislative Decree is the pecuniary one of 41 euros provided for in Article 158, paragraph 5 of the Code for wild parking. The Decree provides for the obligation to take photos for sharing vehicles to prove that the vehicle has been parked well. Some areas of the sidewalks can be dedicated to the parking of all scooters, at the discretion of the Municipality. It will not be necessary to report them with signs and stripes: just publish the GPS coordinates on the municipal website.
From 1 July 2022, the units sold must have arrows and stops. Those already in circulation must be adjusted by 1 January 2024. If the vehicle does not have the legal characteristics, now reordered by the Decree, the confiscation is triggered. So not only if the engine and / or cruise control are "rigged", but also, for example, if the chassis is modified to obtain a seat. Or if, in addition to the lights, arrows and stops will be missing further on.
It is specified that the sanctions are applied according to Title VI of the Code. So, 30% discount if you pay within 5 days, double over 60 days and so on. Scooters are considered to be in circulation if "driven in the areas and spaces" where the Code applies.
Scooters can also circulate on extra-urban roads without cycle paths and violations of the rules of conduct are now punished with a fine of 50 euros instead of 100.
